Terms and Conditions for Koach Kadems Life Coaching Services based in New Jersey

Welcome to Koach Kadems ("Company," "we," "our," or "us"). By accessing this website and engaging in our life coaching services, you agree to the following Terms and Conditions. Please read them carefully.
1. Services Provided
We provide life coaching services intended to support personal development, mindset growth, and goal achievement. Our services are not licensed counseling, therapy, or medical services and are not a substitute for professional advice from licensed professionals such as physicians, psychologists, attorneys, or financial advisors.
2. Not a Licensed Healthcare Provider
In accordance with New Jersey law, we do not diagnose, treat, or cure mental health conditions. If you are experiencing mental health concerns, you should seek assistance from a licensed professional in the State of New Jersey.
3. Client Responsibility
You acknowledge that:
* You are solely responsible for your physical, mental, and emotional well-being.
* You are responsible for your decisions, actions, and results.
* Coaching is a collaborative process, and success depends on your participation and commitment.
4. No Guarantees
We do not guarantee any specific results, outcomes, or earnings from coaching services. Individual results vary based on effort, circumstances, and other factors beyond our control.
5. Payment and Refund Policy
* All services must be paid in advance unless otherwise agreed in writing.
* Fees are non-refundable unless otherwise stated.
* Packages must be used within [12 months] unless otherwise agreed.
* Returned or disputed payments may result in suspension of services.
* Fraudulent disputed payments may result in legal action.
6. Scheduling, Cancellations, and No-Shows
* A minimum of [24 hours] notice is required to cancel or reschedule a session.
* Sessions missed without proper notice may be forfeited.
* Sessions missed or cancelled without proper notice or cause will be charged for the full session.
* Two cancellations without proper notice or Two missed sessions will result in termination of services.
7. Confidentiality
We maintain the confidentiality of all client information to the fullest extent permitted by New Jersey law. However, confidentiality may be broken if:
* Disclosure is required by law (e.g., court order or subpoena)
* There is a reasonable belief of risk of harm to yourself or others
* There is suspected abuse or neglect as required under mandatory reporting laws
* Statements of defamation or threats are made to/against the staff of Koach Kadems.
8. Intellectual Property
All website content, materials, worksheets, and coaching resources are the intellectual property of Koach Kadems & Kelly Kademian and are protected under U.S. copyright laws. You may not reproduce, distribute, or share these materials without written permission. Violation of Intellectual Property will result in a $10,000.00 per piece of material fee that may result in legal action if unpaid.
9. Limitation of Liability
To the fullest extent permitted under New Jersey law, Koach Kadems shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our website or coaching services extended to any advice taken from sessions.
10. Indemnification
You agree to indemnify and hold harmless Koach Kadems from any claims, liabilities, damages, or expenses arising out of your use of the services or violation of these Terms.
11. Website Use
You agree not to:
* Use the website for unlawful purposes under New Jersey or federal law
* Attempt unauthorized access to any part of the website
* Interfere with the operation or security of the website
12. Termination
We reserve the right to terminate or refuse service at our discretion, including if:
* These Terms are violated
* Payment obligations are not met
* The coaching relationship is no longer effective or appropriate
* Statements or threats of harm are made to the staff of Koach Kadems. We reserve the right to get law enforcement involved if we are made to feel unsafe.
13. Dispute Resolution
Any disputes arising under these Terms shall be governed by the laws of the State of New Jersey. You agree that:
* Disputes shall first be attempted to be resolved informally
* If unresolved, disputes may be submitted to mediation or binding arbitration in New Jersey, if agreed by both parties
14. Governing Law and Venue
These Terms shall be governed by the laws of the State of New Jersey. Any legal action shall be brought exclusively in the state or federal courts located within New Jersey.
15. Applicability to Non-New Jersey Clients
These Terms and Conditions are governed by the laws of the State of New Jersey and are intended to comply with applicable New Jersey regulations. By using our services, you agree that these Terms apply to you regardless of your place of residence. Clients accessing services from outside of New Jersey acknowledge and agree that they are subject to these same Terms and Conditions.
15. Changes to Terms
We reserve the right to update these Terms at any time. Updates will be posted on this page with a revised effective date. Continued use of services constitutes acceptance of the updated Terms.
